Terms of Use

These terms of use (hereinafter referred to as the "Terms of Use") define terms of use for services (hereinafter referred to as the "This service") provided by Castle Door Co. (hereinafter referred to as "Our company") provides on this website.
All users (hereinafter referred to as "users") are required to follow these terms and conditions.

Article 1 (Application)

1.This Agreement shall apply to all relationships between user and our company regarding the use of this service.
2.In addition to these Terms of Use, our company may establish various rules and regulations for the use of this service.
(hereinafter referred to as the "Individual Rules").
Regardless of the name, these Individual Regulations shall constitute a part of these Terms.
3.In the event that provisions of this agreement conflict with individual provisions of preceding article, individual provisions shall take precedence unless otherwise specified in the individual provisions.

Article 2 (Management of users and email addresses)

1.The User shall, at its own responsibility, properly manage the user and email address of this service.
2.User shall not, under any circumstances, transfer or lend user or e-mail address to a third party or share it with a third party.
3.Our company shall not be liable for any damage caused by use of user or e-mail address by a third party, except in cases where our company is intentionally or grossly negligent.

Article 3 (Fees and Payment Method)

1.User shall pay fees for the paid portion of this service, which are separately determined by our company and displayed on the web, by the method designated by our company.

Article 4 (Scope of Use)

The scope of use of music works purchased through this service is as follows.
1.It can be used for both commercial and non-commercial purposes.
2.Users are free to modify the sound source (volume and sound quality adjustment, fade in, fade out, looping, etc.). However, we do not allow processing that would significantly change the music.

Article 5 (Prohibited Matters)

Users shall not engage in any of the following acts when using this service.
1.Acts that violate laws or public order and morals.
2.Acts related to criminal acts.
3.Infringement of copyrights, trademarks, or other intellectual property rights contained in this service, including its contents.
4.Destroying or interfering with the server or network functions of our company, other users, or other third parties.
5.Using information obtained through this service for commercial purposes.
6.Transfer, resale, reproduction, or lending of works purchased through this service to a third party.
7.Acts that may interfere with the operation of our service.
8.Acts of unauthorized access or attempts to do so.
9.Acts of collecting or accumulating personal information about other users.
10.Use of this service for illegal purposes.
11.Actions that cause disadvantage, damage, or discomfort to other users of this service or other third parties.
12.Act of impersonating another user.
13.Publicity, advertising, solicitation, or business activities on the service that are not authorized by our company.
14.Directly or indirectly providing benefits to antisocial forces in relation to our services.
15.Other acts that our company deems inappropriate.

Article 6 (Suspension of Provision of the Service, etc.)

Our company may suspend or interrupt the provision of all or part of this service without prior notice to the user if our company deems that any of the following reasons exist.

1.When performing maintenance, inspection, or updating of the computer system for this service.
2.If provision of this service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
3.In the event that a computer or communication line is shut down due to an accident.
4.In other cases where the Company deems it difficult to provide the Service.

Our company shall not be liable for any disadvantage or damage incurred by user or any third party due to the suspension or interruption of provision of this service.

Article 7 (Disclaimer of Warranty and Disclaimer of Liability)

1. We do not warrant, expressly or implicitly, that the service is free from defects in fact or in law. (including, but not limited to, defects in security, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, errors or bugs, or infringement of rights).
2.Our company shall not be responsible for any damage caused to the user due to this service.  However, if the contract between our company and user regarding this service (including this Agreement) is a consumer contract as defined in the Consumer Contract Act, this exemption provision shall not apply.
3.Even in the case specified in proviso of preceding paragraph, our company shall not be liable for any loss or damage caused by our company's default or tort due to its negligence (excluding gross negligence).
(This includes cases where our company or user foresaw or could have foreseen the occurrence of damage).
In addition, compensation for damages caused to a user due to default or tort by our negligence (excluding gross negligence) shall be limited to the amount of the usage fee received from the user for a month in which the damage occurred.
4. Our company shall not be responsible for any transactions, communications, or disputes that occur between a user and other users or third parties in relation to this service.

Article 8 (Change of Service Contents, etc.)

Our company may change the contents or discontinue provision of this service without notice to user, and shall not be liable for any damages incurred to user as a result of such changes.

Article 9 (Changes to the Terms of Use)

Our company reserves the right to change the Terms of Use at any time without notice to the user if it deems it necessary. In the event that user uses this service after Terms are changed, user shall be deemed to have agreed to the changed Terms.

Article 10 (Handling of Personal Information)

Our company shall appropriately handle personal information obtained through the use of this service in accordance with our company's "Privacy Policy".

Article 11 (Prohibition of Transfer of Rights and Obligations)

User may not assign or pledge to a third party his/her position in the User Agreement or rights or obligations under this Agreement without the prior written consent of our company.

Article 12 (Governing Law and Jurisdiction)

1.These Terms of Use shall be governed by and construed in accordance with the laws of Japan.
2.In the event of a dispute regarding this service, the court having jurisdiction over the location where our head office is located shall have exclusive jurisdiction.
